Michelle has been practising as a lawyer for nearly 20 years, commencing her legal career as in-house counsel at a merchant bank in Sydney.  She commenced her career in private practice with Hunt & Hunt in Newcastle in 1995 before moving to Moray & Agnew as a Senior Associate in 2006.  In 2007, Michelle returned to an inhouse role as the Corporate Counsel of the ATB Morton Group of Companies in 2007.

Michelle works predominately in the areas of property and commercial law, however, her role as Corporate Counsel at ATB Morton Pty Ltd has extended her areas of practice to include building and construction and planning law.

Michelle’s property law experience includes:

  • All aspects of domestic and commercial conveyancing, including Old System and Torrens;
  • Property development including property development agreements and joint ventures;
  • Leasing – commercial, industrial and retail;
  • Subdivisions including drafting off the plan sales, drafting by-laws, s88B Instruments;
  • Strata, Neighbourhood & Community Title;
  • Crown leases;
  • Creation, extinguishment and variation of easements including compulsorily acquired easements under s88K of the Conveyancing Act 1919; and
  • Due diligence for property acquisition and finance

When working in private practice, Michelle acted for a range of clients including property developers, financial institutions, corporations and government authorities. For many years she acted for Defence Housing Authority where she was in charge of a legal team dealing with a high volume of matters ranging from acquisitions, sales, leasebacks and subdivisions.

Reg commenced his legal career in South Africa, working first for the Department of Justice in Cape Town and then in the legal department of the Coloured Development Corporation performing corporate and commercial law.

Upon emigrating to Australia in the 1980s, he worked in management positions with various corporations before commencing his legal career in Australia with Hunt & Hunt in January 1992.  He became a Partner with that firm in 1997 and managed the workers compensation and employment law practices in Hunt & Hunt’s Newcastle office.  In 2006 he became a foundation partner of Moray & Agnew’s Newcastle office.

He retired from Moray & Agnew in 2013 and, after a short break, joined Cantle Carmichael as a consultant in October 2013.

He has broad experience in all aspect of workplace accident law, acting for insurers, self-insurers and NSW Treasury Managed Fund and a number of Government Departments..

He is a highly experienced advocate, having successfully represented public and private sector clients before a range of State and Federal courts and tribunals including the Supreme Court, District Court, Workers Compensation Commission, Fair Work Commission and other tribunals.

Brendan Tobin

Brendan practices in the areas of corporate and commercial, commercial litigation, property, planning, environment and resources law He has over 17 years’ experience in national law firms, obtained at all levels including as a partner.

His experience includes:

  • advising a Canadian health care company on the establishment of a presence in Australia;
  • acting for a group of landowners in relation to a co-development agreement for an industrial subdivision;
  • advising a Chinese investor in a $35M shopping centre acquisition in Sydney;
  • drafting planning agreements for residential subdivisions and major projects for clients with the NSW Minister for Planning;
  • advising traditional owners in the Hunter Valley on native title claims in the Hunter Valley;
  • advising Aurizon Operations (formerly Queensland Rail) on the Hexham Train Support Facility near Newcastle. This facility was a $200M project and included the formulation of detailed term sheets, land purchases, negotiation with the Australian Rail Track Corporation and the release and creation of over 20 easements;
  • acting as the lead lawyer for the Cobbora Coal Project. This project was owned by a NSW Government State Owned Corporation and included the purchase of approximately $40M worth of real estate and easements including for a 35 km water pipeline easement over Crown and private land;
  • acting for Macquarie Generation (then owned by the NSW Government) in a $25M real estate and construction project with Glencore/Xstrata including detailed term sheets, construction agreements, land sales, land swaps, complex easement arrangements and dealing with contamination liabilities;
  • representing landowners in negotiations and disputes with mining companies; and
  • incident management and response to safety and environmental matters.
